Requirements for Use

1. You represent and agree with M4G as follows;

1. you have good and marketable title to the property you send in (“the Property”); and
2. you have full authority to sell and transfer the Property;
3. the Property is sold free of all liens, encumbrances, liabilities, and adverse claims of every nature and description whatsoever;
4. the Property is not derived from, or the result of, illegal activity in this country or any other country;
5. you are at least eighteen (18) years of age;
6. any transaction initiated by you will not cause M4G to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of the United Kingdom or any foreign country;
7. you are the actual legal owner of any and all Property offered to be sold to M4G
8. you are acting on your own behalf;
9. the Property will not be sent to us if you know it contains any of the following: Arsenic, Beryllium, Bismuth, Cadmium, Mercury, Nickel, Lead, Antimony, Selenium, Tin, Tellurium or any other deleterious elements; and
10. the information you submit is truthful and wholly accurate.

1.1 M4G may request documentation or other proof of compliance with these requirements.

2. Rules Governing Your Use of our Website.

You represent and warrant that:

1. you will not use this Site for any unauthorized purpose including collecting user names and/or email addresses of other users by electronic or other means for the purpose of sending unsolicited email or other electronic communications;
2. you will not access this Site through the use of scripts, bots or other automated means;
3. you will not access this Site through any means other than through the interface that we provide to you or engage in unauthorised framing of, or linking to, this Site unless otherwise specifically authorised by us in a separate written agreement;
4. you will not transmit chain letters, bulk or junk email or interfere with, disrupt, or create an undue burden on this Site or the networks or services connected to this Site, including, without limitation, hacking into this Site;
5. you will not impersonate any other person or entity, provide false or misleading identification or address information, or invade the privacy, or violate the personal or proprietary right, of any person or entity;
6. you will not circumvent, disable or otherwise interfere with security related features of this Site or features that prevent or restrict use or copying of any Materials (as defined in paragraph 15 below) or enforce limitations on use of this Site or the Materials on this Site; or
7. you will not cause to appear any pop-up, pop-under, exit windows, expanding buttons, banners, advertisements or anything else that minimizes, covers or inhibits the full display of this Site.

3. Returns

You agree that our service begins as soon as you send the Property to us and that once your Property is processed we will physically be unable to return it to you. You will therefore not have a right to cancel our service under the Distance Selling Regulations (if they apply).

4. Guarantee Against Loss/Limitation of Liability

In the event you properly use our provided mailing kit and the mailing kit is initially scanned (or some other evidence of receipt) by the carrier, your Property will be insured against loss for up to £500. If you use your own packaging, you should insure your Property with the carrier for its full value and if it is lost or stolen prior to reaching M4G, then you can make a claim against the carrier. If you wish to insure your mailing kit for more than £500 you may do so at your own expense. M4G utilizes the services of third party carriers such as the Royal Mail for the delivery of our packages. The tracking applications of these third party carriers will be the sole proof that your items were mailed to M4G. M4G reserves the right to reject delivery of any mailing kit or package which appears to be damaged, opened, or tampered with. M4G will seek to exclude liability to you for any such attempted delivery or return of any such items.

5. Guarantee Against Loss.

a. Property Lost when you Initially Send it to Us
Subject to any restrictions in this Agreement or on this Site, if you send your Property to us using our provided mailing kit and your Property is lost in the mail we will compensate you for the loss of your Property to a maximum of £500, provided that you properly pack and send your Property to us in accordance with the terms of this Agreement and the Site.
PLEASE NOTE: In order to submit an insurance claim for lost Property, you must have appraisals or documentation to prove its value, as well as the Royal Mail Special Delivery receipt from the post office and submit that documentation with your claim information.

b. Property Lost when we Send it Back to You

If we return your Property to you, and your Property is lost in the mail, we will pay you the amount that we would normally offer you for your Property (or in accordance with any quote we have provided to you if valid) subject to any restrictions in this Agreement or on this Site.

c. Claim Process

If you wish to submit a claim to us for lost Property, you must immediately contact us at info@money4golduk.com or 0800 043 GOLD (4653) and request a claim form. You must fully complete the form, sign the form and mail it to us at 32 Bloomsbury St. London WC1 3QJ promptly when you become aware that your Property is lost. You must include all supporting documentation with the completed, signed form. Failure to properly complete, sign and/or mail the form, submit the claim form as soon as possible from the date you became aware that your Property was lost, or provide sufficient proof that the Property was mailed to us may prejudice your claim. There is a 30 day waiting period from the time we receive your claim form to the time the claim is processed.

Limited Liability

6. In order to receive a loss guarantee payment or other remuneration from M4G, you must submit a claim to M4G on the claim form provided by M4G. Such forms are available on request. You must submit a claim form promptly and not more than sixty (60) days after the date of mailing your kit. M4G will not accept or process your claim form unless it is fully and accurately completed, signed and delivered to M4G in accordance with the instructions on the claim form. You must submit all supporting documentation with the completed and signed claim form. Failure to comply with all of these requirements may result in the denial by M4G of your claim.

7. We are not liable to you or any third party (including your insurance company) for any money owed, compensation or indirect loss which happens as a side effect of the main loss or damage (loss or damage which does not arise naturally in the usual course of things, but loss which may reasonably be supposed to have been in the contemplation of both parties, at the time we entered into this Agreement, as the probable results of the breach of it) including lost profits or loss resulting from your use of this Site, Contributions, the Materials or any other content on the Site.

8. With the exception of liability for death or personal injury to any person caused by our negligence or that of our agents, which shall be unlimited, our liability to you with respect to any loss suffered by you or by any third party resulting from your use of the Site or our Services, shall not be more than the lower of the following: (a) one-third of the appraised value of all the Property that you submit to us, which appraisal you have obtained from a third party certified appraiser before you send the Property to us; OR (b) one hundred pounds (£100).

Your Liability

9. You agree to compensate us for any reasonable loss, liability, claim or demand, including reasonable lawyer fees, made by any third party due to or arising out of your Contributions, your use of this Site, content on the Site or the Materials in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your promises and representations set out above.

Gold Return Policy and “Double G” Guarantee

10. If you are not satisfied with your payment or for any other reason, simply call our freephone customer service number 0800 043 GOLD (4653) within 48 hours of receipt of payment or within 10 days of the date printed on the cheque and you will receive instructions for the return of your Property. You must return the cheque. You understand that failure to adhere to these procedures might result in the processing of the contents that you submitted and that once processed the Property will not be able to be recovered.

11. You must not submit non-precious materials.  If you submit 100% non-precious materials you will have to pay a shipping, handling and processing charge for such material to be returned to you.

12. If you have received a written quote in good faith from another national gold buyer with television advertising and mail-in service (this guarantee is not intended for any competitors who own or are affiliated with retail locations) for the same precious metals that you submitted to M4G, M4G will pay you double the amount stated on the quote.  Such quote must be dated not earlier than 30 days prior to the M4G payment to you and M4G must be able to verify the veracity of the quote and that the quote was on the same exact precious metals submitted to M4G.  Simply call our freephone customer service number and you will receive instructions on how to send your name, address, tracking number and proof of your higher payout offer.

13. Unless otherwise indicated on the material sent to you by M4G, M4G DOES NOT purchase gemstones. If you plan to send in an item that contains a stone which you believe to be valuable, we strongly recommend removing the stone(s) prior to sending it in to us.  In the event that M4G has received a gemstone from you, the same limitations of liability contained in these terms and conditions shall apply.

Payment Procedures

14. Once your Property has been assessed, a cheque will be sent out to you within 48 hours of such assessment. Property is delivered to our facility five (5) days per week, Monday to Friday, exclusive of national holidays or weekends. In the event the 48 hour period would extend into a weekend or holiday, we aim to issue your cheque on the first business day following the holiday or weekend. For the avoidance of doubt, the 48 hour period does not include the time it takes for your cheque to be delivered to you.

Choice of Law, Waiver, and Claims

15. You expressly agree that these Terms and Conditions, and all M4G transactions, will be exclusively governed by the laws of Laws of England and Wales without regard to its conflict of law provisions. M4G's failure to exercise or enforce any right or provision of these Terms and Conditions will not be deemed to be a waiver of such right or provision. If any of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other terms and conditions will remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the mailing kit or otherwise with M4G must be filed within one (1) year after such claim or cause of action arose or be forever barred.

16. Possible Damage to the Property

By sending us Property, you accept that the process of determining a value may involve:
(a) placing certain acids on the Property and that this can leave permanent staining and/or deep scratches; and
(b) separating different materials or carat grades in the items included in your Property (including but not limited to watches and items containing different materials or carat grades, stones or non-precious materials). Such items may be destroyed and are not recoverable intact if you decide to reject our valuation of the Property.

17. Grant of Licence to Us for Contributions.

We need a licence from you so that we can use your feedback, materials, questions, comments, suggestions, ideas, plans, notes or other information about us, this Site and/or the services made available on this Site (“Contributions”) on this Site or elsewhere. By making a Contribution to this Site, you grant to us a perpetual, non-exclusive (meaning you are free to license your Contribution to anyone else in addition to us) and royalty-free (meaning that we are not required to pay you to use your Contribution), sublicensable (meaning that we can sublicense its rights to, for example, third party hosted service providers) and worldwide (because the Internet and this Site are global in reach) licence to use, modify, create derivative works of, publicly perform publicly display, reproduce, rent, resell and distribute the Contribution for any purpose, commercial or otherwise.
You further grant us the right to use the name that you submit in connection with such Contributions. And, you acknowledge that this license does not obligate us to use your Contributions, or your name in connection with your Contributions.

18. Our Intellectual Property Rights.

All of the content and computer code on this Site (the “Materials”) and the trademarks, service marks, and logos contained on this Site (“Marks”) are owned by or licensed to us and are subject to copyright and other intellectual property rights under English and foreign laws and international conventions. We reserve all rights not expressly granted by this Agreement. The use of this Site grants no intellectual property rights to you.
You may not copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way the Materials other than for your own personal use. Subject to the above, you may download insubstantial excerpts of the Materials to your hard disk for the purpose of viewing it provided that no more than one copy of any information is made.
If you download or print a copy of the Materials for your own personal use, you must retain all copyright and other proprietary notices contained in and on the Materials.

19. Survival.

Even after your use of this Site has ended, this Agreement shall remain in effect.

20. Independent Contractors.

Nothing in this Agreement shall be considered to create an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between us and you.

21. Third Parties

This Agreement is not intended to give rights to anyone except you and us.  This does not affect our right to transfer this Agreement.

22. Generally

We try our best to adhere to promises as to time limits for the despatch of the Property and cheques but there may be occasions where there are short delays.
